Terms of Sale – Digital Photo Downloads
These Terms of Sale govern the purchase of digital photographic downloads ("Digital Products") from TC Motorbike Photography ("we", "us", "our"). By purchasing a Digital Product, you agree to these Terms.
1. Digital Products
All products sold are digital files delivered electronically.
Product images are provided for illustration purposes. Colours and appearance may vary depending on your device, monitor settings, and printer.
2. Payment
Payment must be made in full before any Digital Product is made available for download.
We accept payment through the payment methods offered during checkout.
3. Delivery
Upon successful payment, you will receive access to download your purchased Digital Product via the method described during checkout.
It is your responsibility to provide a valid email address and ensure you download and safely store your purchased files.
If you experience any issues accessing your download, please contact us within 14 days of purchase.
4. Licence
Unless otherwise stated, purchasing a Digital Product grants you a non-exclusive, non-transferable licence to use the purchased image for your own personal use.
You may:
Download and save the purchased file.
Print the image for personal display.
Use the image on your personal devices.
You may not:
Resell, or redistribute.
Claim ownership or authorship of the image.
Alter the image and sell or distribute the modified version.
Use the image for commercial purposes unless a separate commercial licence has been purchased.
Upload the original high-resolution file to websites, file-sharing services, or stock image libraries.
All copyright and intellectual property rights remain the property of [Your Business Name].
5. Commercial Use
Commercial use is not permitted unless expressly authorised in writing or covered by a separate commercial licence.
Businesses wishing to use images for advertising, marketing, products, publications, or resale must obtain an appropriate licence before use.
6. Refunds
Due to the nature of digital products, all sales are final once the download has been made available.
Refunds or exchanges will not be provided because:
you changed your mind;
you purchased the wrong image;
you no longer require the image; or
you are unable to use the file due to software or device incompatibility not caused by us.
If the file is corrupted, incomplete, or cannot be downloaded due to an issue on our part, we will provide a replacement file or, where appropriate, a refund.
7. Consumer Rights
Nothing in these Terms excludes or limits any rights you may have under applicable consumer protection laws.
Where required by law, you expressly acknowledge that by requesting immediate access to digital content you understand that you may lose your statutory right to cancel once the download or streaming of the digital content begins.
8. Intellectual Property
All photographs, graphics, previews, and associated content remain the intellectual property of TC Motorbike Photography
Purchasing a Digital Product transfers only the licence described in these Terms and does not transfer copyright ownership.
9. Limitation of Liability
To the fullest extent permitted by law, our liability arising from the purchase or use of any Digital Product shall be limited to the amount paid for that product.
We are not liable for indirect, incidental, or consequential losses arising from the use or inability to use the purchased files.
10. Security
You are responsible for maintaining the security of your downloaded files. We are not responsible for files lost due to deletion, hardware failure, or other issues occurring after successful delivery.
11. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
